With the health care bill signed into law and a set of “fixes” on its way to the House today, I am proud to stand with my constituents and continue the fight against this government take over of health care. President Obama’s health care bill infringes on Americans’ constitutionally protected liberties; encroaches on the states’ constitutionally guaranteed sovereignty; requires states to spend billions of additional dollars on entitlement programs; imposes an unconstitutional tax; and violates the Tenth Amendment of the United States Constitution.
For the first time in our nation’s history, the federal government is attempting to force individual Americans to purchase services from private companies or face a penalty. Nowhere in the Constitution does it authorize the federal government to mandate, either directly or under the threat of penalty, that all citizens have qualifying health care coverage. By imposing such a mandate, the President’s health care bill exceeds the powers of the United States under Article I of the Constitution and violates the Tenth Amendment to the Constitution.
As the Attorney General of Texas, Greg Abbott, recently stated, “For the first time Congress is attempting to regulate and tax Americans for doing absolutely nothing. H.R. 3590 attempts to tax and regulate each American’s mere existence.” Congress and the federal government must stop weakening the Constitution which is why I have cosponsored a resolution commending the efforts of state legislatures, Attorneys General and citizens to resist the implementation of the health care bill. As citizens of this great country, we cannot and will not cede our constitutionally protected individual liberties.

I hope and wish you would expend your energy on improving the current healthcare reform law and not waste it on repeals. There will always be a first time for everything; I wish y’all will stop playing on people’s emotions and do what’s good for the common. I have worked for the federal government and I know what coverage you have as a federal employee, why isn’t that good for the rest of the nation? What have you done to curb the special interests (groups) that have taken us down the unsustainable model that we had? What were the options/solutions that you proffered on healthcare reform? And while at it, would you care to explain to me why it is mandatory that I get auto insurance and not health insurance? Is my car worth more than I worth?
I DO NOT SUPPORT YOUR EFFORTS TO REVERT THE NEW LAW!!!
Hi John
Keep carrying flag and watching our for our constitutional rights, gotta be tough for the moment, but things can change come November!
Just one quick question: how soon do they deploy the 16,000 newly minted IRS storm troopers to enforce the health care deadbeats? As I understand it, $10bln has been budgeted for these new agents. I guess that is one way to create jobs.
Also did not realize that the new 3.8% Medicare tax on investment income as part of the health care bill would apply to Master Limited Partnerships (MLPs). Which alot of natural gas, refined products, oil and co2 pipelines are set up as.
Since my previous post was removed by this site’s censors, I’ll repost.
Deborah Sly says: “And I oppose any healthcare benefits to illegal immigrants.”
So does the bill the President signed into law.
Also, culberson opposes expansion of Medicaid and opposes ANY FEDERAL GOVERNMENT RUN health care program. So, listen up District 7 seniors 65 and over, your Congressman is on the record as being opposed to Medicare.
This is who you want representing you?? Might be time to re-think that one….
P.S. : I wonder how long it will be before the censors delete this post.
So, if it is wrong for a government to require citizens to “purchase services from private companies or face a penalty,” where does that leave the Texas automobile liability insurance law? It seems like the same idea. As I recall, when George W. Bush signed the law, he said that requiring everyone to purchase insurance would make us more responsible, encourage competition, and lower costs. I may be completely wrong on the Bush thing, but please explain the difference.
I think that you should try a bold public experiment and live without health insurance. Pay for everything completely out your paycheck. Accept no public assistance. Live like many of the taxpayers in District 7. Prove to us that the current system isn’t broken. Show us that quality medical care without insurance is affordable, fair, and easy to obtain. Agree to personally underwrite the medical expenses of taxpayers in your district who don’t have insurance. Prove to us that health care reform isn’t necessary.
An Idea Whose Time Has Come
For too long we have been too complacent about the workings of Congress. Many citizens had no idea that members of Congress could retire with the same pay after only one term, that they didn’t pay into Social Security, that they specifically exempted themselves from many of the laws they have passed (such as being exempt from any fear of prosecution for sexual harassment) while ordinary citizens must live under those laws. The latest is to exempt themselves from the Healthcare Reform that is being considered…in all of its forms. Somehow, that doesn’t seem logical. We do not have an elite that is above the law. I truly don’t care if they are Democrat, Republican, Independent or whatever. The self-serving must stop. This is a good way to do that. It is an idea whose time has come.
Have each person contact a minimum of Twenty people on their Address list, in turn ask each of those to do likewise.
In three days, most people in The United States of America will have the message. This is one proposal that really should be passed around.
Proposed 28th Amendment to the United States Constitution
“Congress shall make no law that applies to the citizens of the United States that does not apply equally to the Senators and/or Representatives; and, Congress shall make no law that applies to the Senators and/or Representatives that does not apply equally to the citizens of the United States”.
You are one of my 20.
I appreciate and support you fighting this bill because of the violation of our rights. I am not oppossed to the bill because of what the bill itself conveys, but because it is a gross overstepping of the constitution for the government to make such a decision that the constitution does not give them the power to make.
I support Health Care and Obama, the lawsuit and repeals are a poor representation of our Congress, the majority has spoken when we elected Obama and now with the passage of Health Care!
Get your facts straight that is why we can not tolerate the rhetoric coming from the GOP
1. Illegal immigrants will not receive these benefits they are excluded they can pay or qualify for subsidies H.R. 3200: Sec 246 — NO FEDERAL PAYMENT FOR UNDOCUMENTED ALIENS
Nothing in this subtitle shall allow Federal payments for affordability credits on behalf of individuals who are not lawfully present in the United State
* Undocumented immigrants would not be able to buy private insurance on the exchange. Those who are lawfully present in this country would be able to participate.
* Undocumented immigrants would be able to buy insurance in the non-exchange private market, just as they do today. That market will shrink as the exchange takes hold, but it will still exist and will be subject to reforms such as the bans on pre-existing conditions and caps.
* Verification will be required when purchasing health insurance on the exchange. One option is the SAVE program (Systematic Alien Verification for Entitlements) which states currently use to make sure that undocumented immigrants don’t participate in safety-net programs for which they are ineligible.
* There would be no change in the law that requires emergency rooms to treat people who need emergency care, including undocumented immigrants. There is already a federal grant program that compensates states for emergency room costs associated with treatment of undocumented immigrants, a provision sponsored by a Republican lawmaker.

I am very much opposed to this Healthcare Bill. I want you to know that I support all your efforts to change this legislation. Mandating healthcare and imposing fines/penalties is something I never dreamed would happen to our country. I would rather have expanded Medicaid to include people who have lost their jobs, etc. Not start a brand new entitlement program. And I oppose any healthcare benefits to illegal immigrants.
Thank you, Mr. Abott and Rep. Culberson. These lawsuits must prevail if we are to save the country.
